eManifest Regulations Are In the Final Stages Before Becoming Mandatory

On February 15, 2014 CBSA published the proposed regulatory updates to the Customs Act. These proposed updates include the mandatory submission of pre-arrival electronic manifest submissions for all commercial carriers entering into Canada by highway. The proposed updates are published in Part 1 the Canada Gazette for 30 days to allow industry to provide comments. Now that the 30 day window is closed, CBSA will begin the process of replying to all comments received. Once CBSA is done responding and making appropriate updates to the regulations the proposed changes will come into effect shortly afterwards. At this point, eManifest will be mandatory and any carriers who are not compliant run the risk of being denied entry and could face financial penalties. CBSA has said that over 95% of highway crossings are eManifest compliant. CBSA is encouraging all remaining highway carriers to become compliant as soon as possible.
